The Warren Commission (WC) said that Lee Harvey Oswald (LHO) murdered President John F. Kennedy (JFK) with a Mannlicher-Carcano (M-C) 6.5mm rifle. There were NO doubts in their minds. So why does the evidence in their twenty-six volumes seem to dispute this conclusion then?
We have seen numerous times in other posts that a rifle OTHER than the alleged murder weapon was found in the Texas School Book Depository (TSBD) by the members of the Dallas Police Department (DPD) and deputies of the Sheriff's Office. We saw also that later on the rifle was still being called a Mauser by District Attorney Wade and Chief of Police Jesse Curry. In fact, a memorandum done by the CIA still called the rifle a Mauser days later!
This post will look at the evidence regarding the rifle found in the TSBD on November 22, 1963, in the twenty-six volumes.

Deputy Sheriff Eugene Boone was one of the two men that found the rifle first. In his report to his boss, Sheriff Decker, he said this:

This report/affidavit was included in the twenty-six volumes of evidence under Decker Exhibit 5323. Surely, if the rifle was NOT a Mauser they would have had him amend this report, right? Why would they include it IF it was incorrect? Also, as stated many times before, the alleged murder weapon had things like “MADE ITALY” and “6.5 CAL.” on it so where did the caliber 7.65 come from if they did NOT see a Mauser of that type?
IF it was a “mistake” as we have been told by the WC, and its current day defenders, then explain why the other person who found the rifle, Deputy Sheriff Seymour Weitzman, said the same thing. Then explain why he was saying the same thing the NEXT DAY!

As you can see from the document it was signed on the day following the assassination so IF he was incorrect why was he still saying it was a 7.65 Mauser then? Notice too, he did NOT waffle as he was pretty emphatic in his wording as he said “The rifle was a 7.65 Mauser…” and NOT it appeared to be like Boone. To date the only refutation the WC and its defenders have offered is Weitzman was incorrect and everyone followed his lead. As we saw in #124 of the "Statements That Sink The WC's Conclusions" series NO one said they got their impression of it being a 7.65 Mauser from Weitzman so this explanation carries no weight.
The next piece of evidence was quoted recently and goes like this:

Sheriff’s deputies identify the weapon as a 7.65 Mauser, a German made Army rifle with telescopic sight. It had one shell in the chamber. Three spent shells were found nearby. This is found in Commission Exhibit (CE) 3048 and we saw a transmission from KBOX (audio reel 1, item 33, 11/22/63) in Dallas on the day of the assassination. IF they too got their information from Weitzman and it was “mistaken” as claimed, why did the media go with it?
We find more evidence that contradicts the claim of the WC. Again, in Decker Exhibit 5323 we find this item.

You will notice that they list a DIFFERENT rifle from the alleged murder weapon. This document cites a “6.25 Italian rifle” instead of the 6.5 M-C claimed to have been used. Why? IF ONLY one weapon was found as claimed, why do we see evidence for a 7.65 Mauser and a 6.25 Italian rifle? Now the 6.25 could have been a typing mistake, but don’t you think they would check this BEFORE making it part of the evidence in a case that involved the murder of the President of the United States? I would think so.
We see further evidence that suggest the thought of other guns being used had occurred to the FBI and the WC. In CE-3049 we see a letter from FBI Director J. Edgar Hoover (JEH) to the WC detailing the laboratory examinations they made on 1336 rifle cartridges provided to them. This report included TEN CARTRIDGES from a Japanese 6.5 mm rifle that was turned in by Floyd Davis at the Sports Drome Rifle Range (SDRR). Why would they test these IF they thought ONLY a M-C was involved?
An additional SIXTY-SIX 6.5 mm M-C rounds [this is incorrect as the M-C simply used 6.5 mm rounds) were turned in by SDRR as well. Where did these come from? We have ZERO evidence LHO was out shooting his alleged M-C, so who was firing these rounds at the SDRR then? We also see one 6.5 mm round from the Lovell Penn incident and four 6.5 mm rounds from the Irving Police Department. Another gun range chipped in another SIXTY-FIVE rounds for examination. Again, since there is NO evidence of LHO practicing with his alleged M-C, who was firing all of this 6.5 mm ammunition at local gun ranges?

The results of all of these tests would be buried in the Robert Gemberling Report (Commission Document (CD) 1107) of 12/10/63. Since the vast majority of CD’s were kept secret and out of the view of the public for many years this was akin to burying the information. The report is now accessible, but NOT easy to navigate on MFF as it spans 1350 pages. I checked the pages that are listed for the results and found something totally different. IF someone can locate the test results for these items it would be appreciated, but in the long run it does NOT matter as JEH said this to the WC:

How fortunate for them, huh? Also, why was there NO interest in who fired the ONE HUNDRED AND THIRTY-ONE rounds of 6.5 mm ammunition at the two gun ranges in the Dallas area? We know it was NOT LHO as the WC found ZERO evidence showing he went to a gun range and provided very shaky evidence showing LHO owned CE-139 to take with him IF he did go to a gun range. So, who fired these shots? Again, 6.5 mm ammunition was NOT common in the Dallas area back then as ONLY two gun shops even sold it. Once again the WC used the “IF it does NOT point to LHO then IGNORE it” strategy.
Finally, we have a CIA report dated three days after the assassination identifying the gun as a Mauser. The report is dated November 25, 1963, and it reads as follows:
