The Warren Commission (WC) claimed Lee Harvey Oswald (LHO) shot and killed Dallas Police Officer J.D. Tippit (JDT) around 1:16 p.m. on November 22, 1963. We have looked at this issue in many posts other posts to see there is NO sound evidence showing this is close to being true. In fact, we have seen there is NO tie between LHO and Commission Exhibit (CE) 143, the alleged murder weapon of JDT, and no evidence showing CE 143 was in fact the murder weapon as claimed.
This post will look at the description that went out at 1:22 p.m. following the shooting of JDT to see if what the WC said is accurate and how it happened.

At 1:22 p.m. the Dallas police radio described the man wanted for murder of Tippit as a “white male about thirty, five foot eight inches, black hair, slender, wearing a WHITE jacket, white shirt and dark slacks.” According to Patrolman Poe this description came from Mrs. Markham and Mrs. Barbara Jeanette Davis. Mrs. Markham told Poe that the man was a “white male, about 25, about five feet eight, brown hair, medium,” and wearing a “white jacket.” Mrs. Davis gave Poe the same general description: a “white male in his early twenties, around five foot seven inches or eight inches, about 145 pounds,” and wearing a white jacket. The first thing we need to note from this statement is that the police radio sent out a description of the shooter of JDT at 1:22 p.m. Remember that as we will come back to that later on. The next thing that has to be covered is if you look at the three descriptions (the one sent out, Mrs. Markham’s and Mrs. Davis’) they do NOT match in some areas. Mrs. Markham said the man was “about 25” while Mrs. Davis said he was in his “early twenties” and somehow that became “about thirty” when the description was sent out over the police radio. How did that happen?
Mrs. Markham also said the man she saw had BROWN hair, but by the time of the broadcast it had become “dark” hair. Why? There is a difference between brown and dark hair. Mrs. Markham said the man she saw was “MEDIUM” and Mrs. Davis said he weight about “145 pounds” (which is slender), so why did the broadcast go with Mrs. Davis’ description but NOT Mrs. Markham’s? Finally, what became of the WHITE jacket both witnesses saw the man wearing? LHO did NOT own a white jacket. These comments by the witnesses (and we have seen other comments by police officer pertaining to a white jacket in other posts) of seeing a white jacket shows the WC lied to us when they wrote this on the same page.

While WHITE can be considered to be a light-color that is NOT an appropriate description here as the WC deliberately avoided mentioning the color white because LHO did NOT own a white a jacket. Furthermore, they would claim CE 162 (gray jacket) was the jacket actually found near the JDT murder scene. This is very misleading by the WC and would fool many who did NOT know the evidence in this case (i.e. the vast majority of people in 1964). It had to be written this way to mislead as there is NO other reason NOT to mention the color white, a color LHO did NOT own in the form of a jacket. Despite this fact, the WC wrote this in their Report regarding the ownership of the jacket.

Do you see the subtle lies the WC is telling? First of all, Captain Westbrook told the WC he did NOT find any clothing or jacket, so why did the WC write that he did?

Mr. WESTBROOK. That was before, Mr. Ball.

Mr. WESTBROOK. Actually, I didn't find it--it was pointed out to me by either some officer that--that was while we were going over the scene in the close area where the shooting was concerned, someone pointed. out a jacket to me that was laying under a car and I got the jacket and told the officer to take the license number.
Secondly, as we have seen numerous times in other posts, a WHITE jacket was found so showing Marina Oswald a GRAY jacket and having her identify it is a waste of time. So she identified CE 162 as LHO’s, but since that was NOT the jacket found near the scene of the shooting how does this support their claim? It doesn’t and is designed ONLY to mislead the reader. Finally, if we actually read the testimony of Marina Oswald and do NOT rely on the claims of the WCR we see the ridiculousness of all of this.
Mr. RANKIN. Do you recall any of these clothes that your husband was wearing when he came home Thursday night, November 21, 1963?
Mrs. OSWALD. On Thursday I think he wore this shirt.
Mr. RANKIN. Is that Exhibit 150?
Mrs. OSWALD. Yes.
Mr. RANKIN. Do you remember anything else he was wearing at that time?
Mrs. OSWALD. It seems he had that jacket, also.
Mr. RANKIN. Exhibit 162?
Mrs. OSWALD. Yes.
This testimony raises so many questions that do NOT support the WC’s claims. First of all, if LHO was wearing CE 150 (brown shirt) on Thursday night (11/21/63) that would mean he had to wear it TWO DAYS IN A ROW without cleaning it. Was this standard practice for LHO? Also, and most importantly for this post, IF he brought CE 162 with him on Thursday night this means he had to wear it to the TSBD the next morning with Wes Frazier, but he left the WC with NO jacket! We know his blue jacket (CE 163) would be found by Frankie Kaiser later on in the TSBD lunchroom so when did he bring this to the TSBD in order to leave it there? Finally, if he wore CE 162 to the TSBD on November 22, 1963, how did he retrieve it at his boarding room as Mrs. Earlene Roberts said he did?

This is more dishonesty by the WC as CE 163 was the BLUE jacket and NOT a “gray blue” jacket. Here is CE 162:

So why was Ball merging them into ONE jacket? This comment shows us LHO had to wear CE 163 to the TSBD on a day he did NOT ride with Frazier.
Mr. BALL - Did you ever see Lee Oswald wear this jacket? [CE 163]
Mr. FRAZIER - No, sir; I don't believe I have.
Frazier claimed he did wear a jacket on the morning of the 22nd however, and if it wasn’t CE 163 or CE 162 (gray one which was at the boarding house), what jacket was this one?
Mr. BALL - On that day you did notice one article of clothing, that is, he had a jacket?
Mr. FRAZIER - Yes, sir.
Mr. BALL - What color was the jacket?
Mr. FRAZIER - It was a gray, more or less flannel, wool-looking type of jacket that I had seen him wear and that is the type of jacket he had on that morning.
Mr. BALL - Did it have a zipper on it?
Mr. FRAZIER - Yes, sir; it was one of the zipper types.
Mr. BALL - It isn't one of these two zipper jackets we have shown?
Mr. FRAZIER - No, sir.
A FLANNEL gray “wool-looking type” of jacket? Where did this come from? Furthermore, where did LHO leave it as NO such jacket was ever associated with him? What happened to this jacket? Finally, how could LHO take CE 162 to the Paine’s house on November 21, 1963, and not wear it on Friday, November 22, 1963 to the TSBD, but then retrieve it at his rooming house later that day? Does this make any sense to you?
For the WC to write what they wrote in their Report required them to DISMISS AND IGNORE all of this evidence available to them. Then WC defenders wonder why the vast majority of people do NOT trust the WCR. Why?
Now, back to the main point of this post. The only things consistent in the three description is the man was white and about five foot eight inches. LHO was listed as 5’9” on some things and 5’11” on other things so even this is not dead on, but it is close enough. The WC never said outright, but alluded to, Dallas Police Officer J.M. Poe being the one to send out this description of the shooter, but if they had listened to his testimony they would KNOW this was not really a wise assumption.
Mr. BALL. What did you do then?
Mr. POE. We gave the description to several of the officers at the scene. You couldn't get on the radio at the time, there was so much traffic on the radio, and the last--the direction he was seen leaving, and then I talked to several more witnesses around there.
Mr. BALL. Did you ever put that description on the radio?
Mr. POE. I believe we did. But I couldn't swear to it.
You’ll notice he said “we” gave the description to “several of the officers at the scene” which implies they then sent out the description and NOT Poe. Mr. Ball then asks him point blank—“Did YOU ever put that description on the radio” and he said “I believe WE did.” Poe was telling them that he did NOT broadcast the description, but they were obviously NOT listening to him. Further confirmation of this comes from this section of his Poe’s testimony.
Mr. BALL. At 1:22 p.m., on the transcript of the radio log, I note it says, "Have a description of suspect on Jefferson. Last seen about the 300 block of East Jefferson. White male, 30's; 5'8", black hair, slender built, wearing white shirt, black slacks."
Do you know whether you gave Walker that description?
Mr. POE. I remember giving Walker a description. My partner got in the car with Walker.
Mr. BALL. Did you give Walker a description similar to that?
Mr. POE. Yes, sir.
Clearly Poe did NOT transmit that description, so who did? Well the WC kind of let it seem like C.T. Walker did since he got the description from Poe and the Dallas Police Department (DPD) radio logs showed this.

IF we go to C.T. Waker’s testimony however we see he was NOT the one that made the FIRST broadcast about the suspect however.
Mr. BELIN. You were not the one that put out the first description of the suspect they sought?
Mr. WALKER. I didn't. The newspaperman was still with me at that time.
He said he was the one who did broadcast that a person fitting the INITIAL description was seen running into the Marsalis library, but that he did NOT broadcast the first description of the shooter. So who did then? It seems it was a Patrolman by the name of R.W. Walker and if you go back to CE 1974 you will see Walker say the man was armed with an unknown type of weapon.
[Note: Sergeant Gerald Hill would broadcast that the shooter had a .38 AUTOMATIC; and Patrolman H.W. Summers will broadcast that the shooter was armed with a .32 AUTOMATIC.]
Immediately after this transmission we see that Poe, and his partner Jez, then arrive at the scene. This again confirms Poe did NOT transmit the initial description of the shooter at 1:22 p.m. as alluded to by the WC. This is very important because a search of radio logs and other evidence has shown researchers that R.W. Walker NEVER had contact with Mrs. Markham or Mrs. Davis so how could he transmit a description given by them? He couldn’t obviously and this would explain the differences in the THREE descriptions since Walker never spoke with either Mrs. Markham or Mrs. Davis. Both of them also saw a gun in the shooter’s hand and Walker seemed unaware if there was a gun of any kind.
Mrs. Markham is a witness that bears strong scrutiny in all her statements as she was incorrect in quite a few things. During her testimony before the WC another description was attributed to her that did NOT match the one already mentioned.
Mr. BALL. On the 22d of November, 1963, that is the day of the shooting, did you talk to an FBI agent named Odum? Do you remember?
Mrs. MARKHAM. I talked to some people, men, down at the police station.
Mr. BALL. That is right. He says that you described the man who shot Tippit as a white male, about 18, black hair, red complexion, wearing black shoes, tan jacket, and dark trousers. Do you remember that?
Mrs. MARKHAM. I never said anything about his shoes because I never did look at his feet.
Mr. BALL. Did you say about 18?
Mrs. MARKHAM. I said he was young looking.
Mr. BALL. Did you give that age, 18?
Mrs. MARKHAM. No, I don't believe I did.
Mr. BALL. Did you say he had black hair?
Mrs. MARKHAM. Yes, sir.
Mr. BALL. You thought he was black-haired?
Mrs. MARKHAM. Yes, that is what I told him. I thought he was black-haired. I remember saying that.
Mr. BALL. Red complexion?
Mrs. MARKHAM. No, not red complexioned.
So based on her comments it would seem FBI Agent Bardwell Odum just made all of this up. The other discrepancy in the initial quote from the WC is Mrs. Barbara Davis said the man she saw had on a dark coat and NOT a white jacket.
Mr. BALL. Did he have a coat on when you saw him?
Mrs. DAVIS. Yes, sir.
Mr. BALL. What color coat?
Mrs. DAVIS. A dark coat.
Despite all of this the WC still went with Poe probably transmitted the initial description of the shooter at 1:22 p.m. and the description came from Mrs. Markham and Mrs. Davis. The WC also turned a blind eye to this transmission from Patrolman H.W. Summers that was made between 1:33 and 1:40 p.m.

221 (H.W. Summers) Might can give you some additional information. I got an eyeball witness to the getaway man; that suspect in this shooting. He is a white male, twenty-seven, five feet eleven inches, 165, black wavy hair, fair complected, wearing light gray Eisenhower-type jacket, dark trousers and a white shirt and but last seen running on the north side of the street from Patton on Jefferson, and was apparently armed with a .32, dark finish, automatic pistol which he had in his right hand.

There is so much in these transmissions to think about and wonder about. First of all, the weapon mentioned by Summers’ witness is a .32 AUTOMATIC and of course this is a long way from the alleged murder weapon—CE 143. The man grew to the height we have seen in quite a few official documents for LHO as well—5’11”.
Secondly, notice how Summers said his witness could POSITIVELY IDENTIFY the shooter, but no attempts were ever made to find out the name of the witness and see if LHO was the man he saw shoot JDT (at least from what we have been told). Why NOT? His description of the shooter does NOT match LHO in anyway as LHO did NOT have “black, wavy hair” or was known to own a .32 automatic pistol. The fact this witness knew a .32 from a .38 is amazing, so the odds of them confusing this for a .38 revolver are pretty much nil. To add more confusion we have Sgt. Hill’s transmission a few minutes after Summers’ transmission and his mentioned a .38 AUTOMATIC.

And Poe showed me a Winston cigarette package that contained three spent jackets from shells that he said a citizen had pointed out to him where the suspect had reloaded his gun and dropped these in the grass, and that the citizen had picked them up and put them in the Winston package.
Three spent jackets? I thought ONLY two were found by Domingo Benavides and turned over to Poe?
Mr. BALL. How many cartridges, or empty cartridges or shells were given to you?
Mr. POE. There were two in an empty Winston cigarette package.
Mr. BALL. Did you save the Winston cigarette package?
Mr. POE. I turned it in with the two cartridges.
What is going on here? Why can’t any area of this case have any consistent evidence? If every case was like this one it would be very understandable if the police solved very few cases. Does this mean in addition to Hill’s inability to read (basically the excuse given by WC defenders for why he missed the stamps at the bottom of the shells) we have to add his inability to count up to THREE correctly? Once again, the WC just chose to ignore these issues presented by Hill.
Thirdly, why did the dispatcher tell Summers they had the suspect “under arrest right now” when this was before LHO was arrested at the Texas Theater (TT)? Shortly thereafter we get another message from Owens saying it was the “wrong man” and they let him go, but why did the dispatcher think the man was under arrest then?
Finally, who was this UNKNOWN who told Summers to hang onto his witness? Did he go and get this witness from Summers? IF so, is this why we have never heard the name of this person? Perhaps this unknown talked him out of being willing to identify a person who was clearly NOT LHO.
We have seen once again that the statements written in the WCR are very misleading at best and outright lies at worst.

Mr. FRAZIER - No, sir; I don't.
This is more dishonesty by the WC as CE 163 was the BLUE jacket and NOT a “gray blue” jacket. Here is CE 162:

So why was Ball merging them into ONE jacket? This comment shows us LHO had to wear CE 163 to the TSBD on a day he did NOT ride with Frazier.
Mr. BALL - Did you ever see Lee Oswald wear this jacket? [CE 163]
Mr. FRAZIER - No, sir; I don't believe I have.
Frazier claimed he did wear a jacket on the morning of the 22nd however, and if it wasn’t CE 163 or CE 162 (gray one which was at the boarding house), what jacket was this one?
Mr. BALL - On that day you did notice one article of clothing, that is, he had a jacket?
Mr. FRAZIER - Yes, sir.
Mr. BALL - What color was the jacket?
Mr. FRAZIER - It was a gray, more or less flannel, wool-looking type of jacket that I had seen him wear and that is the type of jacket he had on that morning.
Mr. BALL - Did it have a zipper on it?
Mr. FRAZIER - Yes, sir; it was one of the zipper types.
Mr. BALL - It isn't one of these two zipper jackets we have shown?
Mr. FRAZIER - No, sir.
A FLANNEL gray “wool-looking type” of jacket? Where did this come from? Furthermore, where did LHO leave it as NO such jacket was ever associated with him? What happened to this jacket? Finally, how could LHO take CE 162 to the Paine’s house on November 21, 1963, and not wear it on Friday, November 22, 1963 to the TSBD, but then retrieve it at his rooming house later that day? Does this make any sense to you?
For the WC to write what they wrote in their Report required them to DISMISS AND IGNORE all of this evidence available to them. Then WC defenders wonder why the vast majority of people do NOT trust the WCR. Why?
Now, back to the main point of this post. The only things consistent in the three description is the man was white and about five foot eight inches. LHO was listed as 5’9” on some things and 5’11” on other things so even this is not dead on, but it is close enough. The WC never said outright, but alluded to, Dallas Police Officer J.M. Poe being the one to send out this description of the shooter, but if they had listened to his testimony they would KNOW this was not really a wise assumption.
Mr. BALL. What did you do then?
Mr. POE. We gave the description to several of the officers at the scene. You couldn't get on the radio at the time, there was so much traffic on the radio, and the last--the direction he was seen leaving, and then I talked to several more witnesses around there.
Mr. BALL. Did you ever put that description on the radio?
Mr. POE. I believe we did. But I couldn't swear to it.
You’ll notice he said “we” gave the description to “several of the officers at the scene” which implies they then sent out the description and NOT Poe. Mr. Ball then asks him point blank—“Did YOU ever put that description on the radio” and he said “I believe WE did.” Poe was telling them that he did NOT broadcast the description, but they were obviously NOT listening to him. Further confirmation of this comes from this section of his Poe’s testimony.
Mr. BALL. At 1:22 p.m., on the transcript of the radio log, I note it says, "Have a description of suspect on Jefferson. Last seen about the 300 block of East Jefferson. White male, 30's; 5'8", black hair, slender built, wearing white shirt, black slacks."
Do you know whether you gave Walker that description?
Mr. POE. I remember giving Walker a description. My partner got in the car with Walker.
Mr. BALL. Did you give Walker a description similar to that?
Mr. POE. Yes, sir.
Clearly Poe did NOT transmit that description, so who did? Well the WC kind of let it seem like C.T. Walker did since he got the description from Poe and the Dallas Police Department (DPD) radio logs showed this.

IF we go to C.T. Waker’s testimony however we see he was NOT the one that made the FIRST broadcast about the suspect however.
Mr. BELIN. You were not the one that put out the first description of the suspect they sought?
Mr. WALKER. I didn't. The newspaperman was still with me at that time.
He said he was the one who did broadcast that a person fitting the INITIAL description was seen running into the Marsalis library, but that he did NOT broadcast the first description of the shooter. So who did then? It seems it was a Patrolman by the name of R.W. Walker and if you go back to CE 1974 you will see Walker say the man was armed with an unknown type of weapon.
[Note: Sergeant Gerald Hill would broadcast that the shooter had a .38 AUTOMATIC; and Patrolman H.W. Summers will broadcast that the shooter was armed with a .32 AUTOMATIC.]
Immediately after this transmission we see that Poe, and his partner Jez, then arrive at the scene. This again confirms Poe did NOT transmit the initial description of the shooter at 1:22 p.m. as alluded to by the WC. This is very important because a search of radio logs and other evidence has shown researchers that R.W. Walker NEVER had contact with Mrs. Markham or Mrs. Davis so how could he transmit a description given by them? He couldn’t obviously and this would explain the differences in the THREE descriptions since Walker never spoke with either Mrs. Markham or Mrs. Davis. Both of them also saw a gun in the shooter’s hand and Walker seemed unaware if there was a gun of any kind.
Mrs. Markham is a witness that bears strong scrutiny in all her statements as she was incorrect in quite a few things. During her testimony before the WC another description was attributed to her that did NOT match the one already mentioned.
Mr. BALL. On the 22d of November, 1963, that is the day of the shooting, did you talk to an FBI agent named Odum? Do you remember?
Mrs. MARKHAM. I talked to some people, men, down at the police station.
Mr. BALL. That is right. He says that you described the man who shot Tippit as a white male, about 18, black hair, red complexion, wearing black shoes, tan jacket, and dark trousers. Do you remember that?
Mrs. MARKHAM. I never said anything about his shoes because I never did look at his feet.
Mr. BALL. Did you say about 18?
Mrs. MARKHAM. I said he was young looking.
Mr. BALL. Did you give that age, 18?
Mrs. MARKHAM. No, I don't believe I did.
Mr. BALL. Did you say he had black hair?
Mrs. MARKHAM. Yes, sir.
Mr. BALL. You thought he was black-haired?
Mrs. MARKHAM. Yes, that is what I told him. I thought he was black-haired. I remember saying that.
Mr. BALL. Red complexion?
Mrs. MARKHAM. No, not red complexioned.
So based on her comments it would seem FBI Agent Bardwell Odum just made all of this up. The other discrepancy in the initial quote from the WC is Mrs. Barbara Davis said the man she saw had on a dark coat and NOT a white jacket.
Mr. BALL. Did he have a coat on when you saw him?
Mrs. DAVIS. Yes, sir.
Mr. BALL. What color coat?
Mrs. DAVIS. A dark coat.
Despite all of this the WC still went with Poe probably transmitted the initial description of the shooter at 1:22 p.m. and the description came from Mrs. Markham and Mrs. Davis. The WC also turned a blind eye to this transmission from Patrolman H.W. Summers that was made between 1:33 and 1:40 p.m.

221 (H.W. Summers) Might can give you some additional information. I got an eyeball witness to the getaway man; that suspect in this shooting. He is a white male, twenty-seven, five feet eleven inches, 165, black wavy hair, fair complected, wearing light gray Eisenhower-type jacket, dark trousers and a white shirt and but last seen running on the north side of the street from Patton on Jefferson, and was apparently armed with a .32, dark finish, automatic pistol which he had in his right hand.

There is so much in these transmissions to think about and wonder about. First of all, the weapon mentioned by Summers’ witness is a .32 AUTOMATIC and of course this is a long way from the alleged murder weapon—CE 143. The man grew to the height we have seen in quite a few official documents for LHO as well—5’11”.
Secondly, notice how Summers said his witness could POSITIVELY IDENTIFY the shooter, but no attempts were ever made to find out the name of the witness and see if LHO was the man he saw shoot JDT (at least from what we have been told). Why NOT? His description of the shooter does NOT match LHO in anyway as LHO did NOT have “black, wavy hair” or was known to own a .32 automatic pistol. The fact this witness knew a .32 from a .38 is amazing, so the odds of them confusing this for a .38 revolver are pretty much nil. To add more confusion we have Sgt. Hill’s transmission a few minutes after Summers’ transmission and his mentioned a .38 AUTOMATIC.

Mr. BELIN. You went back to 400 East 10th Street?
Mr. HILL. Right. And Poe showed me a Winston cigarette package that contained three spent jackets from shells that he said a citizen had pointed out to him where the suspect had reloaded his gun and dropped these in the grass, and that the citizen had picked them up and put them in the Winston package.
Three spent jackets? I thought ONLY two were found by Domingo Benavides and turned over to Poe?
Mr. BALL. How many cartridges, or empty cartridges or shells were given to you?
Mr. POE. There were two in an empty Winston cigarette package.
Mr. BALL. Did you save the Winston cigarette package?
Mr. POE. I turned it in with the two cartridges.
What is going on here? Why can’t any area of this case have any consistent evidence? If every case was like this one it would be very understandable if the police solved very few cases. Does this mean in addition to Hill’s inability to read (basically the excuse given by WC defenders for why he missed the stamps at the bottom of the shells) we have to add his inability to count up to THREE correctly? Once again, the WC just chose to ignore these issues presented by Hill.
Thirdly, why did the dispatcher tell Summers they had the suspect “under arrest right now” when this was before LHO was arrested at the Texas Theater (TT)? Shortly thereafter we get another message from Owens saying it was the “wrong man” and they let him go, but why did the dispatcher think the man was under arrest then?
Finally, who was this UNKNOWN who told Summers to hang onto his witness? Did he go and get this witness from Summers? IF so, is this why we have never heard the name of this person? Perhaps this unknown talked him out of being willing to identify a person who was clearly NOT LHO.
We have seen once again that the statements written in the WCR are very misleading at best and outright lies at worst.
