Notice To Lurkers:
Ben Holmes will deny these very obvious lies by claiming he has given evidence already (a favorite trick of the LNer clan) or that he has quoted me saying something, but do NOT fall for it. Demand him to provide this evidence to you. Demand that he provides my quote IN context as he has a habit of EDITING other people’s words and ignoring clarifications even when they are made BEFORE he responded.
Ben Holmes will resort to insults and false accusations like all LNers do so take note of how often he does this.
-------------------------------------------------------------------------
Now let's add in Ben's own notice to lurkers for his series as he is DOING THE SAME THING HE ACCUSES THE TROLLS OF DOING!
“Important Note for Lurkers - there are many trolls on this forum who's only purpose is to obstruct debate, deny the evidence, and attempt to change message threads from discussing the evidence, to personal insults and attacks.” (Ben Holmes’s Refrain on his “series” posts.)
-------------------------------------------------------------------------
The lies from Ben Holmes are flowing "Fast and Furious" as he is lying his butt off to save himself. Even his "soulmate" ("Walt Cakebread") is keeping his distance from him!
Ben told these lies to Curt Jester:
“This is really a simple question, although you snipped it. What does "federal" law have to do with the state, moron? Why do you refuse to answer that question?
The topic under debate is whether the FBI had jurisdiction in the murder of a President. Since the law that Robsie finally cited, WHICH GAVE THE FBI THEIR JURISDICTION - refers to *any* felonies that fall under the laws of the United States, they clearly *DID* have the authority to involve themselves.
It has *NOTHING* to do with state authority, for the law granting the FBI their jurisdiction MAKES NO MENTION WHATSOEVER OF STATE LAW.” (Ben Holmes to CJ – 9/25/09)
Let's break it down and look at these lies!
“This is really a simple question, although you snipped it. What does "federal" law have to do with the state, moron? Why do you refuse to answer that question?"
Nothing is the answer here as the state and local authorities are NOT subservient to the FEDERAL GOVERNMENT -- at least NOT YET!
"The topic under debate is whether the FBI had jurisdiction in the murder of a President. Since the law that Robsie finally cited, WHICH GAVE THE FBI THEIR JURISDICTION - refers to *any* felonies that fall under the laws of the United States, they clearly *DID* have the authority to involve themselves."
NOTICE the lie here? He claims the killing of JFK VIOLATED FEDERAL LAW IN 1963! He also lies and says ALL FELONIES fall under the FBI's jurisdiction and this is a lie too!
Let's start with the first lie. The FBI DISAGREES WITH Ben's claim and I have posted this many times already and he keeps lying about it.
Quote on
A national tragedy produced another expansion of FBI jurisdiction. When President Kennedy was assassinated, the crime was a local homicide; no federal law addressed the murder of a President. Nevertheless, President Lyndon B. Johnson tasked the Bureau with conducting the investigation. Congress then passed a new law to ensure that any such act in the future would be a federal crime.

This is pretty clear -- THE FBI HAD NO JURISDICTION IN THE JFK CASE UNTIL LBJ GAVE IT TO THEM ON 11/26/63 BECAUSE THE KILLING OF A PRESIDENT WAS NOT A FEDERAL CRIME IN 1963!
The second lie is obvious too. The law we have cited (Title 18, Section 3052) applies ONLY to laws that have been assigned to the FBI BY THE CONGRESS (and in some cases the Attorney General or the President) and NOT all felonies. This guy takes a "federal law" and claims it is the LAW OF THE LAND AND SUPERCEDES ALL STATE AND LOCAL LAWS!
That is not the meaning of the word "federal", this means there is a seperate court and investigations for crimes that pose a threat to the welfare of the country as deemed by Congress. Unfortunately the killing of a President did NOT fall into this category in 1963.
Even his beloved Warren Commission agreed with this fact.
Quote on
There was NO Federal criminal jurisdiction over the assassination of President Kennedy. Had there been reason to believe that the assassination was the result of a conspiracy, Federal jurisdiction could have been asserted; it long has been a Federal law to conspire to injure any Federal officer, on account of, or while he is engaged in, the lawful discharge of the duties of his office. Murder of a President has NEVER been covered by Federal law, however, so that once it became reasonably clear that the killing was an act of a single person, the state of Texas had EXCLUSIVE jurisdiction.” (WCR, p.454) (emphasis mine)

'Tis that simple.
Now for the last part:
"It has *NOTHING* to do with state authority, for the law granting the FBI their jurisdiction MAKES NO MENTION WHATSOEVER OF STATE LAW.”
Of course NOT. The FBI is assigned crimes that affect a large portion of the country and it is easier to consolidate them under one organization. Cr8mes such as bootlegging, bank robbery, drug trafficking, terrorism, high tech crimes, and hate crimes. The FBI was never tasked with solving ALL MURDERS that happen in this country. NEVER!
There is something called the "seperation of powers" (Ben called this concept of our forefathers a "Straw man") and the FEDS have their areas of responsibility and the state and local authorities have their own.
ONLY a truly brazen, and dumb, liar would argue something our law and THE FBI THEMSELVES DO NOT agree with! Here is a comment by Robert P. Gemberling who served in the FBI for 41 years!
Quote on
The NONEXISTENCE of a federal law prohibiting the killing of the President of the United States on November 22, 1963, resulted in Lee Harvey Oswald remaining in the custody of the Dallas Police Department on a TEXAS charge of murder. Oswald was NEVER in the custody of the Federal government because NO Federal agency had JURISDICTION. He had
NOT violated any Federal law. Had Oswald only threatened to kill JFK, he would have been a violation of a Federal law and U.S. Secret Service would have had JURISDICTION.
It was August, 1965, when our Congress finally passed legislation making the killing of a President a Federal violation. JURISDICTION for the enforcement of this 1965 law was GIVEN to the FBI. By then our country was 189-years-old and 4 Presidents had been assassinated.” -- Robert P. Gemberling – FBI Supervisory Special Agent (Ret.) (emphasis mine)

I guess Ben thinks he knows more than the FBI, huh? He has once again told "provable lies" that benefit the Warren Commission's theory! Why? Because the seizure of the evidence on November 22-23 by the FBI and the Secret Service violated the law and negated the value of it in court.
