The Warren Commission (WC) said that Lee Harvey Oswald (LHO) shot and killed Dallas police officer J.D. Tippit (JDT) all by himself on November 22, 1963. They said there were witnesses that showed this to be true as they identified him in lineups conducted by the Dallas Police Department (DPD). This would also apply to a witness that allegedly drove LHO from the point of his exit from the alleged bus ride he took to near his rooming house.
This post will look at some affidavits that were given by witnesses that the DPD claimed showed they selected LHO as the person they saw fleeing the JDT scene with a gun and that claimed he was driven to near his rooming house in the witness’ cab.

So we see both of them claimed to pick LHO out as he was the number 2 man in the lineups they viewed at Dallas Police Headquarters. The odd thing is Detective Leavelle wrote this in his report which can be found in Commission Exhibit (CE) 2003.

This shows that Leavelle had them do their affidavits BEFORE they even viewed the lineup with LHO in it! First of all, how would they KNOW LHO would be the “number two man” when they had NOT even viewed the lineup yet? Obviously there is only one of two possibilities—either the DPD told them that LHO would be in the number two spot or the DPD ADDED this in later on AFTER they gave their affidavit already. Neither one is good for the DPD or the WC’s claims regarding these men identifying LHO as the man they saw running from the JDT murder scene.
In Detective Leavelle’s WC testimony he confirms what his report stated.
Mr. BALL. Do you know what Ted Callaway said?
Mr. LEAVELLE. Not per se; I know they were able to identify Oswald.
Mr. BALL. You say "identify"; that doesn't mean much to me because I don't know what he identified him as.
Mr. LEAVELLE. He said he was the man; he identified him as the man he saw running from the direction where the shots came from over in the Oak Cliff area near his carlot.
Mr. BALL. What about Sam Guinyard?
Mr. LEAVELLE. Same thing, practically.
Mr. BALL. Did you take statements from them?
Mr. LEAVELLE. I believe I took affidavits from them, according to my notes, there while we were waiting for them to come down.
This again shows he took affidavits from these men BEFORE the lineup participants (including LHO) even came down! This same treatment would be corroborated by another witness—William Whaley as he testified to the following before the WC.
Mr. BELIN. Well, was that the fact that you drove until you reached the 500 block, or not?
Mr. WHALEY. No, sir, I didn't drive until I reached the 500 block. I drove until I reached Beckley and Neely. If you would be in my place when they took me down there, when they had to force their way through the reporters to get me in the office, they wrote that up, and I signed it, because I told them that the man said he wanted to go to the 500 block of North Beckley.
Mr. BELIN. All right. Now in here it says, "The No. 3 man who I now know is Lee Harvey Oswald was the man who I carried from the Greyhound Bus Station* * *" Was this the No. 3 or the No. 2 man?
Mr. WHALEY. I signed that statement before they carried me down to see the lineup. I signed this statement, and then they carried me down to the lineup at 2:30 in the afternoon.
Mr. BELIN. You signed this affidavit before you saw the lineup.
Mr. WHALEY. Well, now, let's get this straight. You are getting me confused.
Mr. BELIN. Now, I will put it this way. There was an FBI reporter, FBI interviewer with you?
Mr. WHALEY. Yes, sir; there was.
Mr. BELIN. And there was an interview with the Dallas Police Department?
Mr. WHALEY. Yes. And Bill Alexander from the district attorney's office was there, also.
Mr. BELIN. All right, now, the last sentence.
Mr. WHALEY. Let me tell you how they fixed this up. They had me in the office saying that. They were writing it out on paper, and they wrote it out on paper, and this officer, Leavelle, I think that is his name, before he finished and before I signed he wanted me to go with him to the lineup, so I went to the lineup, and I come back and he asked me which one it was, which number it was, and I identified the man, and we went back up in the office again, and then they had me sign this. That is as near as I can remember.
My recollection for that afternoon in that office was very disturbed because every time they would open the door, some flash camera would flash in your face and everybody coming in and out and asking you questions.
Mr. BELIN. You mean reporters?
Mr. WHALEY. I made this statement more to Bill Alexander, because I tried to talk to him more. Everybody was trying to talk to me at once.
Mr. BELIN. When you saw the statement the first time, did you see the statement before you went down to see the lineup?
Mr. WHALEY. No; I didn't see the statement. I don't think I did. I am not for sure. I think I signed it after I came back. It was on paper. They were writing it up on paper.
Mr. BELIN. They were writing?
Mr. WHALEY. Before I left there, I signed this typewritten, because they had to get, a stenographer typed it up. I had to wait.
Mr. BELIN. But was this before or after you saw the lineup.

Mr. WHALEY. That is when I signed it, after.
Mr. BELIN. Now, when you signed it--what I want to know is, before you went down, had they already put on there a statement that the man you saw was the No. 3 man in the lineup?

Mr. BELIN. Did they have any statements on there before you went down to the lineup?
Mr. WHALEY. I never saw what they had in there. It was all written out by hand. The statement I saw, I think, was this one, and that could be writing. I might not even seen this one yet. I signed my name because they said that is what I said.
This testimony shows the pressure William Whaley was under and shows he was told to sign an affidavit they WROTE for him and one could easily take away from this long exchange that he was told which man to pick based on what they told him prior to viewing he lineup. This would never have stood up in a court of law. He even said he signed his name because they TOLD HIM THAT IS WHAT HE SAID! Talk about pressure and intimidation. Clearly Whaley did NOT pick out LHO as even the WC Report (WCR) said this about what happened.

Whaley’s memory of the lineup is incorrect. There were four men altogether, not six men, in the lineup with Oswald. Whaley said that LHO was the man under No. 2. Actually Oswald was under No. 3. (WCR, p. 161)

He did NOT pick the right man according to the DPD and WC, thus, he could NOT have said he did in his affidavit that the DPD wrote for him.

Mr. WHALEY. No, sir; I did not. They asked me which number he was standing under and he was standing under No. 2.
He consistently said he selected the “number 2 man”, but LHO was the number 3 man in the lineup he saw. Remember, he said this to the WC.
Mr. BELIN. All right. Now in here it says, "The No. 3 man who I now know is Lee Harvey Oswald was the man who I carried from the Greyhound Bus Station* * *" Was this the No. 3 or the No. 2 man?
Mr. WHALEY. I signed that statement before they carried me down to see the lineup. I signed this statement, and then they carried me down to the lineup at 2:30 in the afternoon.
The WC would try and salvage things after this comment and even get Whaley to say he was confused, but this was his FIRST REPLY to their question. Clearly he is saying they had him SIGN his affidavit BEFORE they went to see the lineup! And they had WRITTEN IT FOR HIM to boot! Again, can you imagine how this would have played out in a court of law?
Who was the number 2 man in the lineup that William Whaley saw (after he signed his affidavit saying it was the No. 3 man—LHO)? It was an eighteen-year old named David Knapp. If we go to Dallas Police Detective Walter Potts WC testimony we will find out more about this.
Mr. BALL. How was it conducted? Describe it.
Mr. POTTS. Well, there is an anteroom before you get to the showup stage. Now, the witnesses were out front behind this transparent black nylon screen. There's a light set at an angle on the stage where the person on the stage can't see the people out in the audience. They brought them out handcuffed together and this John Thurman Horne went in first--no, that's wrong--Lujan went on first, because he would be No. 4. You see, they've got numbers above the--above them higher up there.
Mr. BALL. What is his full name?
Mr. POTTS. Daniel Lujan, and then Oswald was No. 3, Knapp No. 2.
Mr. BALL. What is Knapp's full name?
Mr. POTTS. David Knapp and John Thurman Horne was No. 1.
This testimony shows us that David Knapp is who William Whaley identified and NOT LHO! Potts would also tell us that Knapp lived in Oak Cliff like LHO!
Mr. POTTS. Yes; and this David Edmond Knapp, he was 18….
Mr. BALL. And do you have the addresses of these three men?
Mr. POTTS. Yes; I do--now, I got the addresses off of---out of our records bureau--off of their arrest cards. I don't know whether they gave a fictitious address or not.
Mr. BALL. And what about David Knapp, what was he in for?
Mr. POTTS. He was in for investigation of theft and he lived at 2922 Alabama. That's in Oak Cliff.
Based on the total lack of credible evidence showing LHO was ever in William Whaley’s cab, why isn’t it reasonable to wonder if Knapp was the person Whaley drove to Oak Cliff that afternoon? It would have helped to know what time Knapp was arrested by the DPD to see if this was possible or not, but as usual the WC was not helpful in this detail. The possibility that this was David Knapp would fill in some blanks for us as this makes more sense than saying it was LHO. LHO did go to his rooming house, but he either might have gotten a ride or he took a bus there directly based on what he said himself during his interrogations.
Some have said that the name “Darryl Click” was a transcription mistake by the press or the stenographer during District Attorney Henry Wade’s November 24, 1963, press conference. Supposedly someone thought “Oak Cliff” was the same as Darryl Click. IF this is true, and I have not seen any evidence showing it is for sure, then why did the WC ask William Whaley about a “Darrell Click?”
Mr. BALL. Do you know a taxi driver named Darrell Click?
Mr. WHALEY. I may know his face, sir, but not his name.
Mr. BALL. You don't know his name?
Mr. WHALEY. We go mostly by numbers.
If the Darryl Click issue was the result of a “mistake” as I am told, why was the WC even wasting time on asking Whaley if he knew a the man? IF it was a “transcription error” as I am told, why would they expect Whaley to know a man who does NOT exist?
Once again we see the evidence in the twenty-six volumes of Hearings & Exhibits does NOT support the claims the DPD and the WC made, thus, their conclusion cannot be true, therefore, it is sunk.
P.S. WCR claim of transcription error Tom Scully brought up. This makes me very suspicious of him.
