The Warren Commission (WC) said Lee Harvey Oswald (LHO) shot and killed President John F. Kennedy (JFK) and Dallas Police officer J.D. Tippit (JDT) on November 22, 1963. They said after killing JDT LHO ran to the Texas Theater (TT) on the north side of Jefferson Boulevard.
They further claimed he ducked into the TT without paying and made his way to the main lobby of the theater. We will look at these claims in more detail in this post.

The whole reason LHO was supposedly spotted was due to Johnny Brewer who managed a shoe store, Hardy’s Shoestore, which was a few doors down from the TT. Brewer had heard via radio reports that both JFK and JDT had been shot and when he saw a man duck into the lobby in front of his store he thought the man “…just looked funny” due to his hair being sort of messed up and it looked like he had been running. Brewer said he looked “scared and funny” to him so he followed the man to the TT and saw him duck into the TT without paying. He would check with TT employee Julia Postal who was manning the box office to see if the man he saw had paid for a ticket and she said, “No; by golly, he didn’t.” She had left the box office and stepped to the curb to see what the sirens were for. This should make one ask then, if she was not watching the TT as the WC claimed, how in the world did she know what man Brewer was talking about? Also, how did she know he did NOT pay if she did not even know whom Brewer was talking about?
The WC was clear on this and it reads as follows in their Report (WCR).

One can presume quite safely that her BACK would have been to the TT so how did she know what Brewer was talking about in the first place, and secondly, know whether the man paid or not? The WC was also quite careful not to say explicitly where LHO went into the theater, but given all the discussion they thought he went to the LOWER portion (i.e. main floor). We have seen this in other posts that LHO would be detained on the lower main floor. However, we have also seen before where a police transmission said the suspect was in the BALCONY and the man we know as LHO was never up there, so who was this person?
In the account of the arrest the WC excludes one witness that they did call—Warren Burroughs—and do not mention him or what he told to them at all. I wonder why? We saw this transmission by the Dallas Police Department (DPD) in an earlier post.

He is a key witness, and yet, the WC did NOT mention this testimony at all in the account of the arrest in their Report. Why not? Also, he could not have confused this person for anyone else as he said he did not see anyone else come in without a ticket.
Mr. BALL. Did anybody come in there that day? Up to the time of the struggle between the man and the police who didn't have a ticket?
Mr. BURROUGHS. No, sir.
During the week Burroughs was stationed at the concession stand and tasked with checking tickets before someone entered the main floor.
Mr. BURROUGHS. During the week I worked behind the concession. On weekends I usher.
Mr. BALL. During the week?
Mr. BURROUGHS. I am behind the concession.
Mr. BALL. During the afternoon of the week----do you take tickets too?
Mr. BURROUGHS. Yes----I take tickets every day.
Mr. BALL. You do?
Mr. BURROUGHS. Yes.
Mr. BALL. And, run the concession?
Mr. BURROUGHS. Yes.
Mr. BALL. If anybody comes in there without a ticket, what do you do, run them off?
Mr. BURROUGHS. I make it a point to stop them and ask them to go out and get a ticket. I just failed to see him when he slipped in.
Thus, if this person came in (presumed to be LHO) and they did not pass Burroughs the ONLY place they could have gone was up to the balcony since there is a stairway near the front door. Another question is this, how did the police know the suspect went to the balcony if the suspect never did like the WC claimed? Who were the police speaking with to learn this information? We see two transmissions above by them so someone either had to tell them this (and again whom could this be?) or they knew ahead of time the pattern the “patsy” was supposed to follow. Which do you think it is?
Burroughs testified about later, but it doesn’t explain how the DPD knew this when they transmitted the location BEFORE LHO was actually arrested.

This is not a trivial point as the arrest report for LHO would show a time on it that was ELEVEN MINUTES before LHO was actually arrested! The time on the arrest report reads 1:40 p.m. and LHO was NOT arrested at the TT until 1:51 p.m. so it seems someone had advanced knowledge of his pending arrest. You will see it says without a doubt LHO killed JFK and JDT when he was ONLY arrested for killing JDT! He would not be charged with the murder of JFK until the early morning hours of November 23, 1963, so why is the arrest report claiming this on it?
When you add this to the fact the DPD were saying he was in the balcony when he was NOT according to the WC, then you see either a foreknowledge of where the suspect was supposed to be INSIDE the TT or that the WC is lying to us and not telling us where the real person who did not pay went.
The topic of LHO not being provided with a lawyer has come up many times in this discussion and the WC defenders claim LHO did not want one or only wanted one particular lawyer or was NOT entitled to one. First of all, we all heard him ask for one while in police custody. Secondly, he did NOT ask for one lawyer as the WC and its defenders claim as John Abt said neither LHO or anyone representing him ever contacted him to see if he would represent LHO. Finally, LHO knew his rights and he knew he was entitled to one and Burroughs proves this for us with this testimony.
Mr. BALL. Did you hear or see any trouble between this man and the police?
Mr. BURROUGHS. Well, I heard a struggle from outside, but I really couldn't tell.
Mr. BALL. What did you hear?
Mr. BURROUGHS. Well, I couldn't hear anything on the inside, but when they brought him out, he was hollering and raising, "I demand my rights," and all that.
Mr. BALL. Tell me what his appearance was as they brought him out?
Mr. BURROUGHS. Well, he didn't seem---he seemed like he was mad at everybody.
Mr. BALL. He was?
Mr. BURROUGHS. Yes.
Mr. BALL. Did he shout in a loud voice?
Mr. BURROUGHS. Yes; like "I demand my rights" [witness holding up both above his head.]
This shows without a doubt LHO knew his rights and DEMANDED them from the DPD, but he was NEVER given his rights as he had NO lawyer the whole time he was in custody. He was also NOT allowed to remain silent either.
