Why did the WC keep referring to Lee Harvey Oswald (LHO) as being a Communist when their OWN evidence shows he was NEVER a member of the Communist Party?
As we saw in the testimony of Frances Knight (State Department) there was NO evidence showing LHO ever joined a Communist party.
Mr. COLEMAN. Would you look at category K, and I would like to ask you whether the information which was in the file on Mr. Oswald, including the FBI reports, which were in the file of June 1963, should have caused Oswald to be put in category K?
Miss KNIGHT. No; I don't think so.
Mr. DULLES. Could you read category K?
Miss KNIGHT. Yes; certainly. "K" is "Known or suspected Communist or subversive". And "does not include those falling within categories O and P".
Senator COOPER. The point I am making is, am I correct or are you correct, when you say at the time Oswald's passport was either issued or renewed to make the trip to Mexico City, that there was no evidence in his files of any kind which would indicate that he was a member of a Communist organization?
Miss KNIGHT. No, sir; there was nothing in the file.
As we see he NEVER joined the Communist party, but the WC kept calling him a Communist. Why? Especially when further evidence exists in their twenty-six volumes! If we go to Commission Exhibit (CE) 1070, page 3 we will see this comment on the first page.

Interview of petitioner’s brother, R.L. Oswald, disclosed NO evidence that petitioner was ever a member of the Communist Party. Investigation conducted by the Federal Bureau of Investigations likewise DID NOT establish Communist Party membership of the petitioner. (Emphasis mine) (CE 1070, p. 1)

By memorandum dated October 27, 1961, the Dallas office of the Federal Bureau of Investigations granted clearance to conduct an investigation of the petitioner. Wither their letter was furnished a copy of an investigative report made by S/A John W. Fain on July 3, 1961. This report CORROBORATED the information furnished by R.L. Oswald and covers an interview with the petitioner’s mother. She furnished NO information indicating the petitioner was EVER A MEMBER of or affiliated with the Communist Party and expressed surprise that he had gone to Russia to live. (Emphasis mine) (CE 1070, p. 3)
