Why was Lieutenant Carl Day so confused about the finding of the rifle and what was marked on the rifle?
In his WC testimony Lt. Day said the following:
Mr. BELIN. I am going to hand you what has been marked Commission Exhibit 139 and ask you to state if you know what this is.
Mr. DAY. This is the rifle found on the sixth floor of the Texas Book Store at 411 Elm Street, November 23, 1963.
Why did Lt. Day think the rifle—CE-139, the alleged murder weapon—was found on NOVEMBER TWENTY-THIRD in the Texas School Book Depository (TSBD)? Wasn’t he there on November 22, 1963, to see the alleged murder weapon being found? Perhaps the frame rifle was NOT found until the 11/23/63 and Day made a “Freudian Slip” here, huh?
The WC quickly corrected him of course. Oops.
Mr. BELIN. What date?
Mr. DAY. November 22, 1963.
Day’s gaffes would NOT stop there though as he would mess up again a few questions later!
Mr. BELIN. Do you have any recollection as to what the serial number was of that?
Mr. DAY. Yes, sir; I recorded it at the time, C--2566.
What? I thought the alleged murder weapon had the serial number “C-2766” on it? Oops again. He said he has it “recorded” to be C-2566 so one has to wonder WHAT RIFLE had this number on it?
He again will quickly recover, but one has to wonder if he really had all this “recorded” why was his memory so bad?
Mr. BELIN. Before you say that----
Mr. DAY. C-2766, excuse me.
It could make one think he was messing up because he was simply telling the truth RATHER THAN WHAT HE WAS SUPPOSED to be saying.
