The Warren Commission (WC) claimed Lee Harvey Oswald (LHO) shot and killed President John F. Kennedy (JFK) all by himself on November 22, 1963. They also claimed he shot and killed Dallas Police Officer J.D. Tippit (JDT) on the same day before he was arrested for officially “acting suspicious” and “not paying for a movie ticket”.
In this post I will look at some of the things the WC claimed regarding what LHO supposedly said during his interrogations with the Dallas Police Department (DPD), FBI and Secret Service (SS) on Friday, November 22, 1963. Keep in mind that we are lacking a good bit of stuff as there are no reports for the three Friday (11/22/63) interrogation sessions (4:20, 6:20 and 7:40 p.m.) or any transcripts for the supposed two arraignments LHO participated in. (I say supposedly since we have seen there is NO evidence for the alleged second arraignment at 1:30 a.m. (11/23/63) for the murder of JFK.) It is very important that we have NO record of what LHO said in the three interrogation sessions on Friday.
We also have NO notes or recordings of what was said either and have to rely on reports of some of the people involved in these sessions. Furthermore, since Captain Fritz said he did NOT take notes, and no recording or transcription is available, one has to wonder how he remembered all this for his report. Or if he remembered it CORRECTLY for his report.

What we do have to work with is a report by Captain Will Fritz of the Homicide & Robbery Bureau of the DPD. This report is found in Appendix XI of the WC Report (WCR). During his summary of what LHO allegedly said, he wrote this on what was said about where he worked in the Texas School Book Depository (TSBD).

This is incorrect, but enlightening. It is incorrect because all other reports show LHO saying he USUALLY worked on the FIRST FLOOR and not the second floor. It is enlightening because it shows LHO spent a good part of his time on the first floor and NOT the sixth floor as we have been led to believe. While it is said his job caused him to go to various floors it has been IMPLIED that he either spent a lot of time on the sixth floor or that he worked there primarily. Both of these scenarios are incorrect. This was corroborated by William Shelley in his WC testimony.
Mr. BALL - Were there certain floors that he worked more upon which he worked more frequently than other floors?
Mr. SHELLEY - The first floor is where all the order filling is done; the 5th, 6th, 7th floor are used for storage and when they need stock on the first floor anybody goes up and gets it.
Mr. BALL - So he would work mostly on the first floor and sometimes on 5, 6, and 7, is that what you mean?
Mr. SHELLEY - Yes.
This shows us his ONLY reason for going to the sixth floor would be to “get stock” for filling on the first floor. The issue of him spending the majority of his time on the first floor is very important because he said this when asked what he was doing at the time of the assassination.

I asked him what part of the building he was in at the time the President was shot, and he said that he was having his lunch about that time on the first floor. (Ibid.)

It makes sense since he usually worked on the first floor to have his lunch on the first floor. I have shown evidence before in this series that puts LHO on the first floor at the time of the shots based on how he entered the second floor lunchroom without being seen by either Roy Truly or DPD officer Marrion Baker. The only way this could have happened is by entering the second floor lunchroom from the FIRST FLOOR entranceway and NOT using the back stairway as the report said Roy Truly had stated.

Either Roy Truly was confused--which is hard to believe since he was there when Baker confronted LHO and Truly vouched for him—or Fritz wrote down incorrect information. Either way, we know LHO was confronted in the second floor lunchroom by Baker. Also, note how the report said that LHO was stopped IMMEDIATELY after the shooting so again we see this would NOT have allowed time for LHO to do what was attributed of him and get down four stories so fast.
Both Eddie Piper and William Shelley testified to seeing LHO on the first floor eating his lunch shortly before noon as well.
Mr. BALL - Did you see him from time to time during that day?
Mr. SHELLEY - I am sure I did. I do remember seeing him when I came down to eat lunch about 10 to 12.
And:
Mr. BALL - What time did you go to work that day?
Mr. PIPER – 10 o’clock.
Mr. BALL – Did you ever see him again that day?
Mr. PIPER – No.
Mr. BALL – What was the last time you saw him?
Mr. PIPER – Just at 12 o’clock.
Mr. BALL – Where were you at 12 o’clock?
Mr. PIPER – Down on the first floor.
This would seem to corroborate LHO’s statement, but of course the WC would have NONE of it as they said he did not bring a lunch and did not bother to see if he could have purchased a lunch to eat. The evidence found in the WC’s own twenty-six volumes lean towards LHO’s statement and NOT the WC’s claim. We also have Carolyn Arnold’s statement about seeing LHO in the first floor lunchroom around 12:15 p.m. as well. This had been buried in a Commission Document (CD 5) and not found until 1967 by researcher Harold Weisberg.
On the next page of the report we see the following.

We also know that Warren Caster did bring into the TSBD two rifles on November 20, 1963, and both Roy Truly and William Shelley had said they had NEVER seen anyone bring rifles to work before. Both of these men viewed the rifles Caster brought in (a 30.06 Sporterized Mauser and a .22 Remington) on that day.
Mr. BALL. Had you ever seen any guns in that building before that date?
Mr. SHELLEY. No, sir.
And:
Mr. BALL. Whose guns were they?
Mr. TRULY. They belonged to Mr. Warren Caster.
Mr. BALL. Now, before inquiring into the circumstances of seeing two guns that belonged to Mr. Warren Caster on November 20, 1963, I'll ask you whether or not you ever at anytime before that time or after that time saw guns in the Texas School Book Depository Building?
Mr. TRULY. Never before.
Obviously, the fact Caster brought in two rifles (two types that had a caliber mentioned a lot in the shooting of JFK) two days before the assassination and this had NEVER happened before bears more scrutiny. Why this issue has received so little coverage is beyond me.
LHO said this about renting his room at the rooming house under a different name.

One of the officers had told me that he had rented the room on Beckly under the name of O.H. Lee. I asked him why he did this. He said the landlady did this. She didn’t understand his name correctly. (XI, p. 4)

It was suggested that this was another lie by LHO as he used this name as an alias and was trying to hide this to the DPD. Why he would lie about this is beyond me as it is NO crime to use a fake name to rent a room. The WC would again use Marina Oswald to show that LHO used a fictitious name to rent his room.
Mr. RANKIN. Do you recall where he was when he gave this fictitious name?
Mrs. OSWALD. What do you mean where he was? From where he telephoned?
Mr. RANKIN. Yes, or the number that he gave you--that is the rooming house that he was at when he used this fictitious name, and you told us you called there.
Mrs. OSWALD. He lived at first in one place, and then he changed. It was the last place where he had given a fictitious name…
Mr. RANKIN. You don't remember the fictitious name that he gave you?
Mrs. OSWALD. I read in the paper after everything happened, but at that time I didn't know. He said that his last name was Lee. He didn't say that. I read that in the paper.
Mr. RANKIN. Did that remind you, then, that that was the name they gave you when you called and he answered the telephone?
Mrs. OSWALD. No, No one told me anything. I didn't know under what name he lived there.
Mr. RANKIN. But you found out that he was not living under his own name, is that what you meant before?
Mrs. OSWALD. Yes.
So in a roundabout way they got her to say LHO used a fictitious name that ended in “Lee” (O.H. Lee), but this is hardly convincing. What it does show is that LHO gave her this telephone number because she was close to giving birth to their second baby and he wanted to be notified in case she was going into labor. Based on this, IF he was registered as O.H. Lee, why would he not tell her to ask for him under that name?
All the questions listed in this report by Frtiz shows the focus was already on LHO and LHO alone as none ventured into the area of accomplices (e.g. conspiracy). Why NOT? How could they know at this point there was NO conspiracy in play? These questions were asked on Friday, the day of the assassination between 2 and 4 p.m., so why were they NOT exploring the possibility?
The other thing we don’t see is ONE question pertaining to JDT, and yet, this is what LHO was arrested for! All the questions pertained to the assassination of JFK and LHO would not be charged with that crime officially until 11:26 p.m. that night. Of course, all we have to go on for all of this is the report by Fritz as the DPD did NOT transcribe these interrogations which is beyond belief as this case involved the murder of a president.
This report does NOT cover the time after 4:00 p.m. either and the WC wrote this about that time in terms of the interrogation of LHO.

After the lineup, at about 4:20, Oswald was returned to Captain Fritz’ office for further questioning. Two hours later at 6:20 p.m.., Oswald was taken downstairs for a second lineup and returned to Captain Fritz’ office within 15 minutes for additional interrogation…After a third lineup at 7:40 p.m., Oswald was returned to Fritz’ office. About an hour later, after further questioning, Oswald’s fingerprints and palmprints were taken and a paraffin test administered in Fritz’ office, after which the questioning resumed. (WCR, p. 198)

This questioning went on until 11:26 p.m. when LHO was officially charged with the murder of JFK. There are no notes, transcription of these questions and answers and NO lawyer for LHO during all of this time (4:20-11:26 p.m.). All we see in Frtiz’report was this from the earlier session.

Oswald asked if he was allowed an attorney and I told him he could have any attorney he liked, and that the telephone would be available to him up in the jail and he could call anyone he wished. (Appendix XI, p. 4)

Of course it doesn’t work this way in real life as the accused is allowed to say they want an attorney and the police have to secure him one, even if it is just a public defender, as all the accused is granted is one phone call! That is it, but we saw LHO placing quite a few calls to Ruth Paine. Why is that? It was NOT LHO’s job to phone an attorney and secure their services given the type of charges he was facing. It was the Constitutional responsibility of the City of Dallas to secure him one. This never happened though. Why?

This right comes from the Constitution so it was around in 1963 in case the WC defenders try and claim it was not. I will look at the Saturday and Sunday morning interrogations in other posts, but we have seen again the evidence does NOT support the claims and conclusions the WC made in their Report, thus, they are sunk.
