How could the Warren Commission (WC) and the House Select Committee on Assassinations (HSCA) determine that Lee Harvey Oswald (LHO) shot and killed Dallas Police Officer J.D. Tippit (JDT) when they couldn’t match the bullets inside him to the alleged murder weapon?
The HSCA Says...The JDT Bullets.

The WC’s expert FBI witness, Cortland Cunningham, nor the expert panel of the HSCA could show the four bullets taken from JDT’s body matched Commission Exhibit (CE) 143 as they provided us with this evidence.
Mr. RHYNE. And with respect to the bullets that were found in the body of Officer Tippit, you testified that you could not be positive that they were fired by this weapon, Exhibit 143.
Mr. CUNNINGHAM. I could not identify those bullets as having been fired from that gun.
Mr. RHYNE. Based on your experience in your study of these bullets, do you have an opinion as to whether or not they were fired by this gun?
Mr. CUNNINGHAM. No, sir; I cannot determine that.
Mr. RHYNE. You have no opinion at all?
Mr. CUNNINGHAM. The only thing I can testify to, is they COULD have, on the basis of the rifling characteristics--they could have been. However, NO CONCLUSION COULD BE REACHED FROM AN ACTUAL COMPARISON OF THESE BULLETS WITH TEST BULLETS OBTAINED FROM THAT GUN.
Mr. RHYNE. Even though there are a lot of similar markings.
Mr. CUNNINGHAM. There are not; no, sir. There are not a lot of similar markings. They are similar. The rifling characteristics, are the same, or similar. But, in the individual characteristic marks, there are not
a lot of similarities. THERE ARE NOT SUFFICIENT SIMILARITIES TO EFFECT AN IDENTIFICATION.
Representative BOGGS. Stating Mr. Rhyne's question negatively, THESE BULLETS COULD HAVE BEEN FIRED BY ANOTHER WEAPON?
Mr. CUNNINGHAM. THAT IS CORRECT. Either this weapon or ANOTHER WEAPON THAT HAS THE SAME RIFLING CHARACTERISTICS.
And:
Mr. EISENBERG. Now, were you able to determine whether those bullets have been fired in this weapon[/b]?
Mr. CUNNINGHAM. No; I was not.
And:
"....The panel was unable to conclude that the Tippit bullets were fired from the CE 143 revolver." (7 HSCA 381)
Now we can add some more comments by the HSCA. The HSCA wrote this in their report.

The committee’s firearms panel determined positively that all four cartridge cases found at the scene of the Tippit murder were fired from the pistol that was found in Lee Harvey Oswald’s possession when he was apprehended in the Texas Theater thirty five minutes after the murder. 13 (HSCAR, p. 59)

The first question that comes to mind for me is what pistol was found in the possession of LHO during his apprehension at the Texas Theater (TT)? It was claimed it was CE 143, but as we have seen before there is NO chain of possession that shows it was that particular weapon LHO allegedly had on him. The next thing we have to look at is their note (13) which appeared on the bottom of this page.

(13) Since Oswald’s revolver had been partially modified to shoot different ammunition than the type it was manufactured to shoot, it was NOT POSSIBLE for the panel to determine whether the bullets that killed Tippit WERE FIRED FROM IT. The panel did determine that the characteristics of the bullets were consistent with their having been fired from Oswald’s revolver. (Ibid., note 13)

First of all, what was LHO’s revolver? It was claimed it was CE 143, but again, the WC nor the HSCA ever put forth evidence showing that he ordered and received that particular revolver as they claimed. Secondly, notice they said they could NOT determine that the bullets that killed JDT were fired from CE 143, thus, they had NO firm evidence showing this was the murder weapon. Despite this total lack of evidence for showing LHO owned or had CE 143 in his possession and that CE 143 was the murder weapon of JDT, they still claimed LHO was the murderer of JDT! They used the favorite tactic of “the panel determined that the characteristics of the bullets were consistent with them having been fired from Oswald’s revolver…” nonsense. As we just said, they could NOT show CE 143 was LHO’s revolver and they could NOT show it was the murder weapon, so what are they talking about?
False claims are abundant in the official conclusion. Do you think that someone would be found guilty in a court of law if you could not show:
1) That they owned or had possession of the murder weapon;
2) That the weapon that was determined to be the murder weapon was fired by them; and,
3) That the weapon you determined was the murder weapon did NOT match the bullets in the deceased?
What court of law would allow you to find someone guilty without supporting these basic things with evidence? None most likely, but that is exactly what the WC and HSCA asked us to believe.
